Challenge
Vikram Nair, a senior software architect working in Dubai since 2020, had accumulated significant investments in India — fixed deposits, mutual funds, and a rental property in Kochi. He was unsure about his tax residency status and whether he needed to file returns in India. In April 2025, he received a notice from the Income Tax Department questioning why he hadn't filed returns despite significant financial transactions in India (₹45 lakh in FD renewals and mutual fund redemptions). He was also worried about double taxation on his UAE income.
Solution
Our NRI tax specialists first determined Vikram's residential status under Section 6 of the Income Tax Act. Since he had been in UAE for more than 182 days per year for 3 consecutive years, he qualified as a Non-Resident. We then: (1) Filed his income tax returns for 3 assessment years (2022-23 to 2024-25) showing only Indian-sourced income; (2) Claimed exemption on his UAE salary income as it is taxable in India only if earned in India; (3) Properly reported capital gains on mutual fund redemptions; (4) Claimed TDS refund of ₹1.2 lakh that was incorrectly deducted on FD interest; (5) Advised on the tax implications of his rental property including standard deduction of 30%; (6) Helped him open an NRE account for better tax efficiency going forward.
RESULTS
All 3 years' returns were filed within 45 days with zero additional tax liability. Vikram received a TDS refund of ₹1.2 lakh within 60 days. The income tax notice was closed after submission of the returns. He now has a clear understanding of his Indian tax obligations and an optimized investment structure. His rental income is now properly declared with correct TDS filings by the tenant.
